What is Royal Decree 933/2021 about?

Royal Decree 933/2021 has established new obligations for traveller registration that include the request for certain guest data. This regulation applies to all tourism operators, whether public or private, digital platforms and non-professional individuals, who will be responsible for identifying to the authorities the guests who rent their accommodation. The registration obligation will come into force 6 months after the publication of the regulation, i.e., from June 2, 2023, while the communication of data will be mandatory from January 2, 2023.

Who is this new regulation aimed at?

The new regulation applies to natural or legal persons who offer accommodation services in exchange for financial remuneration, including hotels, hostels, guesthouses, apartments, rural houses, bungalows or other modalities within national territory.

What new obligations exist for traveller registration?

The new regulation establishes that owners of tourist accommodation must submit a registration form that includes traveller information. Likewise, they will be responsible for verifying the accuracy of the data provided by travellers and must create a digital file with the data collected for a period of 3 years after the service ends.

Important: The Ministry of the Interior has created the SES.HOSPEDAJES platform on its electronic headquarters in order to help individuals or legal entities that offer accommodation services in the management of documentary registration and the provision of necessary information.

What data must be collected when registering travellers?

Those responsible subject to the obligation must maintain an electronic record containing the data specified in Annex I of Royal Decree 933/2021.

When does this new regulation come into effect?

Royal Decree 933/2021 specifies that the communication obligations will come into force on January 2, 2023, but a transition period is granted until June 2, 2023, to allow the different obliged parties to adapt and integrate their systems with the application and familiarise themselves with it. This means that during the next five months, no sanctions or fines related to the obligation to communicate traveller information will be applied.
